Fair Procedure Law Advice

If an employer dismisses an employee, the employer must be able to show that that there were fair grounds for the dismissal and that fair procedures were followed. If an employee claims unfair dismissal, the employer has to prove the dismissal was fair, there were fair grounds for dismissal and fair procedures were followed.

Under Ireland’s unfair dismissals legislation, employees may request from their employer a written statement of the reasons for dismissal. The employer should provide this within 14 days of the employee’s request.
